Whose Regulations are More Strict: Your State or the EPA?

Did you know that some states have hazardous waste management regulations that are actually more stringent than the EPA?

Did you know that some states have hazardous waste management regulations that are actually more stringent than the EPA? If your company handles hazardous waste, it is important that you stay educated on the most up-to-date regulations for your area. You can also partner with a responsible, experienced hazardous waste management company such as AEG Environmental for all of your hazardous waste disposal needs.

Why would the regulations be different?

The Resource Conservation and Recovery Act (RCRA) of 1976 gave individual states the right to dictate their own hazardous waste management standards, within EPA guidelines of course. Under the RCRA, states’ hazardous waste standards must meet certain minimum requirements. Because the power to dictate regulations lies with the individual states, there are often many differences in policies from state to state. If your business operates in multiple states, make sure you are well acquainted with the regulations in each one.

Differences in Hazardous Waste Definitions

Often, the most noticeable differences will lie in the definitions of hazardous waste. For example, the EPA may define a material one way, but an individual state may say that the EPA’s standard is too loose and define it more stringently. States are well within their rights to be more stringent with hazardous waste regulations than the EPA, and they often are.

Other Differences You May Find

  • Some states require hazardous waste reports to be filed annually, as opposed to every other year.
  • Some hazardous waste management tasks require state-specific paperwork that shows more information than federal forms.
  • Regulations for central accumulation areas may be different for “permitted” and “un-permitted” hazardous material generators.
